1. Acceptance of Terms

By accessing and using Futures Buddy ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Futures Buddy is a professional trading analysis platform that provides real-time market insights, scalp setup detection, market confluence analysis, and technical indicators for NQ (Nasdaq Futures) trading. The Service is provided as a desktop application with cloud-based data processing.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use this Service. By using the Service, you represent and warrant that you meet these requirements.

4. Subscription and Payment

4.1 Subscription Plans: We offer monthly ($59.90/month) and yearly ($560/year) subscription plans. All prices are in USD.

4.2 Payment Processing: Payments are processed securely through Stripe. You agree to provide accurate and complete payment information.

4.3 Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

4.4 Price Changes: We reserve the right to modify subscription prices with 30 days' notice. Changes will apply to renewals after the notice period.

4.5 Free Trials: If offered, free trials are limited to one per customer. Credit card information may be required and will be charged upon trial expiration unless cancelled.

5. Cancellation and Refunds

5.1 Cancellation: You may cancel your subscription at any time through the customer portal. Access continues until the end of the current billing period.

5.2 No Refunds: All subscription fees are non-refundable. We do not provide refunds or credits for partial months or years of service, downgrades, or unused periods of paid subscriptions.

5.3 Exceptions: Refunds may be considered on a case-by-case basis for technical issues that prevent service use, at our sole discretion.

6. Trading Disclaimer

6.1 Not Financial Advice: Futures Buddy provides technical analysis and market insights for informational purposes only. Nothing in the Service constitutes financial, investment, trading, or legal advice.

6.2 Your Responsibility: All trading decisions are your sole responsibility. You acknowledge that futures trading carries substantial risk and you could lose more than your initial investment.

6.3 No Guarantees: We make no guarantees or warranties regarding trading results, profitability, or the accuracy of any analysis, signals, or indicators provided by the Service.

6.4 Past Performance: Past performance is not indicative of future results. Hypothetical or simulated performance results have inherent limitations.

6.5 Professional Advice: You should consult with a qualified financial advisor before making any investment decisions.

7. Acceptable Use

You agree not to:

Share your account credentials with others
Use the Service for any illegal purpose
Attempt to reverse engineer, decompile, or hack the Service
Redistribute or resell data or insights from the Service
Use automated systems to access the Service excessively
Interfere with or disrupt the Service or servers
Violate any applicable laws or regulations

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, algorithms, and software, are owned by Futures Buddy and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy. We do not have access to your brokerage accounts or trading credentials. All trading execution occurs through your chosen broker, not through our Service.

10. Service Availability

10.1 Uptime: We strive to maintain 24/7 service availability but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates, or due to technical issues.

10.2 Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

10.3 Data Accuracy: While we strive for accuracy, we cannot guarantee that all market data, indicators, or analysis will be error-free or up-to-date at all times.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURES BUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Futures Buddy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

13. Termination

13.1 By You: You may terminate your account at any time by cancelling your subscription through the customer portal.

13.2 By Us: We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms.

13.3 Effect: Upon termination, your right to use the Service immediately ceases. Provisions that should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Futures Buddy is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be subject to binding arbitration.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use after such modifications constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Futures Buddy regarding the Service and supersede all prior agreements and understandings.
